                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            April 13, 2015      TO: Honorable Geanie Morrison, Chair, House Committee on Environmental Regulation      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB2598 by Kuempel (Relating to the consideration of steel slag as solid waste by the Texas Commission on Environmental Quality.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would exclude steel slag from regulation as a solid waste. Although passage of the bill would not result in a significant additional workload to the Texas Commission on Environmental Quality (TCEQ), the TCEQ reports that because the bill would exempt all steel slag from regulation, and not be limited to nonhazardous waste, the bill would create law in conflict with federal law, which could threaten the state's Resource Conservation and Recovery Act (RCRA) delegation. This estimate assumes that any resulting loss in Federal Funds would be offset by a reduction in RCRA-related activities required of the TCEQ.
