                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            March 20, 2015      TO: Honorable Larry Phillips, Chair, House Committee on Homeland Security & Public Safety      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB278 by Ashby (Relating to authorizing certain attorneys representing the state to openly carry a handgun.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Penal Code to create a defense to the prosecution of unlawful carrying of a handgun by a license holder for certain attorneys representing the state and makes the offenses of unlawful carrying a weapon and carrying a weapon in places that are prohibited not applicable for certain attorneys representing the state. These offenses are punishable by a Class A misdemeanor or a third degree felony, depending on the circumstances. This analysis assumes the provisions of the bill would not result in a significant impact on state correctional agencies Local Government Impact No significant fiscal implication to units of local government is anticipated.
