The bill would amend the Natural Resources Code to require a municipality that established a maximum proximity allowance for mineral exploration and development to apply the allowance uniformly to the development of identified markers within its boundaries. Under the provisions of the bill, a property owner or lessee would be permitted to petition a municipality for a waiver to utilize property within the area created by the proximity allowance. If the petition is granted, the waiver must be recorded in the county records. Local Government Impact No significant fiscal implication to units of local government is anticipated.
