The bill would amend the Natural Resources Code to require a municipality that established a maximum proximity allowance for mineral exploration and development to apply the allowance uniformly to the development of identified markers within its boundaries. Under the provisions of the bill, a property owner or lessee would be permitted to petition a municipality for a waiver to utilize property within the area created by the proximity allowance. Under the provisions of the bill, the approval of a waiver would serve as a revision to the municipality's maximum proximity allowance. Local Government Impact No significant fiscal implication to units of local government is anticipated.
