                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            April 19, 2015      TO: Honorable Drew Darby, Chair, House Committee on Energy Resources      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB2993 by Paddie (Relating to the authority of a municipality to regulate location of mineral exploration and development activities within its boundaries.), As Introduced    No fiscal implication to the State is anticipated.  The bill would amend the Natural Resources Code to require a municipality that established a maximum proximity allowance for mineral exploration and development to apply the allowance uniformly to the development of identified markers within its boundaries. Under the provisions of the bill, a property owner or lessee would be permitted to petition a municipality for a waiver to utilize property within the area created by the proximity allowance. Under the provisions of the bill, the approval of a waiver would serve as a revision to the municipality's maximum proximity allowance.
