 A BILL TO BE ENTITLED
 AN ACT
 relating to overtime pay for certain information technology state
 employees.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 659.015(i), Government Code, is amended
 to read as follows:
 (i)  With authorization from the administrative head of the
 agency for which an employee works, or that person's designee, an
 employee may be paid an amount based on the employee's regular rate
 of pay for:
 (1)  the hours of compensatory time the employee earns
 for work directly related to a disaster or emergency declared by the
 appropriate officer of the state or federal government; or
 (2)  all or part of the hours of compensatory time the
 employee earns for work in an information technology position
 requiring skills in high demand in the information technology labor
 market.
 SECTION 2.  Section 659.016(i), Government Code, is amended
 to read as follows:
 (i)  Except as provided by this subsection and Subsection
 (j), an employee covered by this section may not be paid for any
 unused compensatory time.  With authorization from the
 administrative head of the agency for which a state employee works,
 or that person's designee, an employee may be paid an amount based
 on the employee's regular rate of pay for:
 (1)  the hours of compensatory time the employee earns
 for work directly related to a disaster or emergency declared by the
 appropriate officer of the state or federal government; or
 (2)  all or part of the hours of compensatory time the
 employee earns for work in an information technology position
 requiring skills in high demand in the information technology labor
 market.
 SECTION 3.  The changes in law made by this Act apply only to
 compensatory time earned on or after the effective date of this Act.
 SECTION 4.  This Act takes effect September 1, 2015.
