AUTHOR'S / SPONSOR'S STATEMENT OF INTENT Interested parties explain that associations of regional governments in Texas, commonly known as councils of government, regional planning commissions, or development councils, consist of city and county leaders who work together for the betterment of the entire region. These organizations are required to offer a member of the legislature who represents a district located in the applicable region membership in the organization as a nonvoting, ex officio member. However, the parties contend that this requirement does not provide for each legislative member who represents a district in the region to be offered that membership. H.B. 3167 addresses this issue by amending the applicable law. H.B. 3167 amends current law relating to the governing bodies of certain local planning organizations. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 391.006, Local Government Code, by amending Subsection (c) and adding Subsection (d), as follows: (c) Requires the governing body of a commission of a region that is consistent with the geographic boundaries of a state planning region to offer an ex officio, nonvoting membership on the governing body to each member of the legislature who represents a district located wholly or partly in the region of the commission. (d) Provides that an ex officio member is not counted for purposes of determining a quorum. SECTION 2. Effective date: upon passage or September 1, 2015.
