The bill would amend the Local Government Code to specify the establishment of programs under Section 399, Local Government Code is a governmental function for all purposes. The bill would permit a representative of a local government to take actions under the chapter instead of a local governmental official. The bill would permit a program application fee paid by the property owner to be expressed as a set amount, a percentage of the amount or in any other manner. Under the provisions of the bill, a report for a proposed program would be required to include a form contract between the local government and the property owner specifying the terms of financing provided by the local government if applicable. Local Government Impact No significant fiscal implication to units of local government is anticipated.
