The bill would amend the Local Government Code to specify the establishment of programs under Section 399, Local Government Code is a governmental function for all purposes. The bill would permit a representative of a local government to take actions under the chapter instead of a local governmental official. The bill would permit a program application fee paid by the property owner to be expressed as a set amount, a percentage of the amount or in any other manner. Under the provisions of the bill, a report for a proposed program would be required to include a form contract between the local government and the property owner specifying the terms of financing provided by the local government if applicable.
