 A BILL TO BE ENTITLED
 AN ACT
 relating to a federal waiver to allow the Texas Education Agency to
 administer annual assessment instruments based on modified
 achievement standards for certain public school students.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Not later than January 1, 2016, the Texas
 Education Agency shall apply to the United States Department of
 Education for a waiver of the federal prohibition on the use of
 annual assessment instruments based on modified achievement
 standards for students served by special education services.
 SECTION 2.  After receiving the waiver requested under
 Section 1 of this Act, the Texas Education Agency shall administer
 the STAAR-M assessment instrument to eligible special education
 students beginning with the 2016-2017 school year.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2015.
