The bill would amend the Education Code related to public school accountability. The bill provides further direction to the Commissioner of Education for the purpose of determining a charter renewal or charter revocation. The bill would require the commissioner to consider an alternative operation of the school before considering revocation.The bill would require the commissioner to allow representatives of the charter holder to meet with the commissioner to discuss the commissioner's decision and allow the charter holder to submit additional information related to the commissioner's decision. The commissioner would be required to provide a written response to any information the charter holder submitted when the final decision is issued. The bill would allow the State Office of Administrative Hearings to include in charter school reviews accreditation and financial performance ratings. The bill would take effect on September 1, 2015, or immediately if passed with the necessary voting margins, and apply beginning in school year 2015-16.Based on the analysis of the Texas Education Agency and the State Office of Administrative Hearings, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
