                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            April 19, 2015      TO: Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB3415 by Canales (Relating to the award of court costs, storage fees, and attorney's fees in a criminal asset forfeiture proceeding.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Code of Criminal Procedure to require a court under certain specified conditions to order a law enforcement agency that seized certain property to reimburse the owner of the seized property for any court costs, storage fees, and reasonable attorney's fees using funds established under Article 59.06(c) for the benefit of law enforcement services.  It is assumed any costs associated with the implementation of the bill could be absorbed within current resources.  Local Government Impact There would be costs to local law enforcement agencies to reimburse applicable owner or interest holder for court costs, storage fees, and reasonable attorney's fees. However, fiscal impact would vary depending on the number of applicable cases.
