A BILL TO BE ENTITLED
AN ACT
relating to the availability of information regarding the
eligibility of persons with disabilities to use certain public
transportation services.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 461.009, Transportation Code, is amended
by adding Subsection (c) to read as follows:
(c) The department shall post on the department's Internet
website information regarding how an individual who is eligible to
use a provider's services may access another provider's services
when the individual visits the other provider's service area. The
website must identify each provider's service area and provide
contact information for each provider.
SECTION 2. Chapter 461, Transportation Code, is amended by
adding Section 461.010 to read as follows:
Sec. 461.010. DATABASE OF PUBLIC TRANSPORTATION SERVICES
FOR PEOPLE WITH DISABILITIES. (a) In this section, "provider" and
"services" have the meanings assigned by Section 461.009.
(b) The department shall establish a database of all
individuals who are eligible to use a provider's services in this
state and authorize each provider in the state to access the
database. Each provider in the state must maintain data in the
database identifying each individual who resides in the provider's
service area and who is eligible to use the provider's services.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2015.
