CRIMINAL JUSTICE IMPACT It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS H.B. 640 amends the Government Code to add a temporary provision, set to expire January 1, 2017, to require the Department of Public Safety (DPS) to conduct a study determining the feasibility of establishing a system to allow a person to use a digital image displayed on an electronic device for identification purposes or to prove that the person has a driver's license, evaluating risks to personal information security that such a system might create, and surveying and evaluating digital identification and proof of licensure policies in other states. The bill requires DPS, not later than September 1, 2016, to submit a detailed report of its findings and recommendations to the legislature. EFFECTIVE DATE On passage, or, if the bill does not receive the necessary vote, September 1, 2015.
