The bill would amend the Government Code relating to financial assistance administered by the Texas Department of Housing and Communitty Affairs (TDHCA) in certain rural areas. TDHCA would be required to establish a process by which to designate certain cities with a population under 10,000 in a metropolitan area as rural for the purposes of TDHCA financial assistance and explicitly requires related rule making. Establishing the process would include the required rule-making but would also involve developing an application process, review of applications received, making recommendation for Board approval, review of appeals, and preparation of appeal information for the Board. This would also likely add additional related appeals and challenges during the competitive Housing Tax Credit ("HTC") funding process. Based on the analysis of TDHCA, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing respources.
