The bill would amend Chapter 108 of the Health and Safety Code relating to health care data collected currently by the Department of State Health Services (DSHS). The bill would require DSHS to develop a database that does not include identifying information for use as required by law. The bill would require that DSHS make a form available on the DSHS website for use by providers to notify patients whose health data is being collected. The bill would require that DSHS prepare an annual report on security related to the data. The bill would prohibit DSHS from collecting a fee for the data from a health and human services agency. DSHS indicates that this could result in a revenue loss of up to $200,000 per fiscal year, and that the agency would need to reallocate existing resources.
