                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            May 8, 2015      TO: Honorable John Whitmire, Chair, Senate Committee on Criminal Justice      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB904 by Smith (Relating to the transfer of certain inmates to the Texas Department of Criminal Justice following pronouncement of the inmate's sentence.), As Engrossed    No significant fiscal implication to the State is anticipated.  The bill would amend the Code of Criminal Procedure as it relates to the transfer of certain inmates to the Texas Department of Criminal Justice (TDCJ) following the pronouncement of the inmate's sentence. Under the provisions of the bill, certain felony offenders sentenced to a term of incarceration of less than 10 years would be transferred to TDCJ upon pronouncement of the sentence even if the defendant has provided notice of an appeal.   This analysis assumes the provisions of the bill would not result in a significant impact on state correctional agencies.The bill would take effect on September 1, 2015. Local Government Impact No significant fiscal implication to units of local government is anticipated.
