AUTHOR'S / SPONSOR'S STATEMENT OF INTENT Current law requires a school district to seek commissioner approval from the commissioner of education for a school district teaching permit. (See Section 21.055, Education Code) The agency does not have established guidelines on issuing permits, as individuals education and work experiences vary. The proposed legislation would allow school districts to issue a teaching permit. Districts would not have to ask the agency for approval in order to issue permits for non-core courses. Those being issued teaching permits would still be required to have a bachelor's degree. As proposed, S.B. 1003 amends current law relating to eliminating the commissioner of education's authority to approve a school district's issuance of a teaching permit. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 21.055(e), Education Code, to prohibit a person issued a school district teaching permit under this section from teaching in another school district unless that district issues a school district teaching permit, rather than prohibits a person authorized to teach under this section from teaching in another school district unless that district complies with this section. SECTION 2. Repealer: Sections 21.055(c) (requiring a school district, after employing a person under this section, to send to the commissioner of education a written statement identifying certain information about the newly hired person) and (d) (requiring the commissioner of education to notify the school district if the commissioner finds the person in the written statement under Subsection (c) is not qualified to teach), Education Code. SECTION 3. Effective date: upon passage or September 1, 2015.
