A BILL TO BE ENTITLED
AN ACT
relating to relating to the definition of a dependent for health
benefit plans offered by certain university systems.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 1601.004, Insurance Code, is amended by
adding Subsections (c) and (d) to read as follows:
(c) Notwithstanding Subsection (b)(2), "spouse" means:
(1) a husband or wife; or
(2) a member of a civil union or similar relationship
that is entered into in this state or another state and is between
individuals of the same sex.
(d) Subsection (c) takes effect only if the United States
Supreme Court or other court of competent jurisdiction holds
invalid, enjoins, or otherwise prevents enforcement of any law in
this state that prohibits:
(1) the marriage of individuals of the same sex; or
(2) the recognition of a civil union or similar
relationship entered into in another state between individuals of
the same sex.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2015.
