                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            April 23, 2015      TO: Honorable Larry Taylor, Chair, Senate Committee on Education      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:SB1222 by Bettencourt (relating to the authority of the commissioner of education to issue subpoenas during an investigation of educator misconduct.), Committee Report 1st House, Substituted    No significant fiscal implication to the State is anticipated.  The bill would allow the Commissioner of Education to issue a subpoena in the course of an educator misconduct investigation. The bill would allow the Commissioner to file suit in a district court to enforce a subpoena if a person failed to comply. Subpoenaed materials could be used in a disciplinary proceeding against an educator based on an alleged incident of misconduct.
