A BILL TO BE ENTITLED
AN ACT
relating to a prohibition on local solid waste management
regulations that are inconsistent with a permit or regulations of
the Texas Commission on Environmental Quality.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 361.096, Health and Safety Code, is
amended by amending Subsection (a) and adding Subsection (c) to
read as follows:
(a) Except as provided by Subsection (c) and as otherwise
specifically provided by this chapter, this subchapter does not
limit the powers and duties of a local government or other political
subdivision of the state as conferred by this or other law.
(c) Notwithstanding any other law, a local government or
other political subdivision of the state may not adopt a rule or
ordinance that conflicts with or is otherwise inconsistent with the
requirements for solid waste management facilities as specified by
the rules of the commission or by a permit issued by the commission.
SECTION 2. This Act takes effect September 1, 2015.
