AUTHOR'S / SPONSOR'S STATEMENT OF INTENT S.B. 945, 83rd Legislature, Regular Session, 2013, helped hospital patients understand the level of training for those providing direct patient care. Specifically, the bill required a health care provider in a hospital to wear a photo identification badge clearly stating the providers name, department, and license type. It is the intent of S.B. 1753 that patients are promptly and clearly informed of the training and qualifications of their health care provider. S.B. 1753 amends the Health and Safety Code to further specify the qualifications for a hospital badge to identify the type of license a health care provider to be identified by one of the following license types: physician, chiropractor, podiatrist, mid-wife, physician assistant, acupuncturist, surgical assistant, dentist, hygienist, nurse, optometrist, speech language pathologist, audiologist, physical therapist, medical radiologic technologist, medical physicist, perfusionist, respiratory care practitioner, orthotist, prosthestist, or dietician. As proposed, S.B. 1753 amends current law relating to the identification requirements of certain health care providers associated with a hospital. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 241.009, Health and Safety Code, by adding Subsection (c), as follows: (c) Requires that the identification badge of a health care provider licensed under Title 3 (Health Professions), Occupations Code, for purposes of Subsection (b)(3), clearly state: (1) "physician," if the provider holds a license under Subtitle B (Physicians) of that title; (2) "chiropractor," "podiatrist," "midwife," "physician assistant," "acupuncturist," or "surgical assistant," as applicable, if the provider holds a license under Subtitle C (Other Professions Performing Medical Procedures) of that title; (3) "dentist" or "dental hygienist," as applicable, if the provider holds a license under Subtitle D (Dentistry) of that title; (4) "nurse," if the provider holds a license under Subtitle E (Regulation of Nursing) of that title; (5) "optometrist" or "therapeutic optometrist," as applicable, if the provider holds a license under Subtitle F (Professions Related to Eyes and Vision) of that title; (6) "speech-language pathologist" or "audiologist," as applicable, if the provider holds a license under Subtitle G (Professions Related to Hearing, Speech, and Dyslexia) of that title; (7) "physical therapist," "occupational therapist," or "massage therapist," as applicable, if the provider holds a license under Subtitle H (Professions Related to Certain Types of Therapy) of that title; (8) "medical radiologic technologist," "medical physicist," "perfusionist," "respiratory care practictioner," "orthotist," or "prosthetist," as applicable, if the provider holds a license or certificate, as appropriate, under Subtitle K (Professions Related to Use of Certain Medical Equipment) of that title; and (9) "dietitian," if the provider holds a license under Subtitle M (Regulation of Other Health Professions) of that title. SECTION 2. Effective date: January 1, 2016.
