The bill would amend the Code of Criminal Procedure, prohibiting a peace officer from searching a person's cell phone or other wireless communications device without a search warrant. The bill would prescribe the procedure, format, and required information for an application for a search warrant. The bill would provide exceptions to the search warrant requirement. The Office of Court Administration indicates bill provisions are not anticipated to have a significant fiscal implication for the court system. The Department of Public Safety indicates it can implement bill provisions within existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
