                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            April 18, 2015      TO: Honorable John Whitmire, Chair, Senate Committee on Criminal Justice      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:SB1864 by Burton (Relating to requiring a peace officer to obtain a warrant to search a cellular telephone or other wireless communications device.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Code of Criminal Procedure, prohibiting a peace officer from searching a person's cell phone or other wireless communications device without a search warrant.  The bill would prescribe the procedure, format, and required information for an application for a search warrant.  The bill would provide exceptions to the search warrant requirement. The Office of Court Administration indicates bill provisions are not anticipated to have a significant fiscal implication for the court system. The Department of Public Safety indicates it can implement bill provisions within existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
