The bill would amend the Local Government Code to permit a county officer to access certain information from a county governmental body. The bill would establish a procedure of maintaining confidentiality of the information. Under the provisions of the bill, a county officer may seek a decision from the Attorney General whether information is confidential or excepted from disclosure. The Attorney General would be required to respond to the county by issuing a written decision within 45 days or within an extension of the 45 day period by 10 business days. A county officer or county governmental body may appeal the decision to a district court under certain conditions. The Office of Court Administration reported no significant fiscal impact to the state court system is anticipated.
