                    BILL ANALYSIS             S.B. 374     By: Schwertner     State Affairs     Committee Report (Unamended)             BACKGROUND AND PURPOSE    In late 2014, Governor Perry signed an executive order requiring all state agencies to use the federal E-verify program. The E-verify program is an online system that compares information about a new employee's identification to data from the U.S. Department of Homeland Security and Social Security Administration to ensure employment eligibility. S.B. 374 seeks to codify this executive order.       CRIMINAL JUSTICE IMPACT   It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.       RULEMAKING AUTHORITY    It is the committee's opinion that rulemaking authority is expressly granted to the Texas Workforce Commission in SECTION 1 of this bill.       ANALYSIS    S.B. 374 amends the Government Code to require a state agency, defined as a department, commission, board, office, or other agency of any branch of state government, including an institution of higher education, to register and participate in the federal E-verify program to verify information of all new employees and to require the Texas Workforce Commission to adopt rules and prescribe forms to implement this requirement.       EFFECTIVE DATE    September 1, 2015.
