AUTHOR'S / SPONSOR'S STATEMENT OF INTENT Despite a statutory requirement that all public schools have automated external defibrillators (AED) on campus and make available AED training for volunteers and district staff, the only people on campus required to be trained in using an AED in schools are school nurses, assistant nurses, and athletic personnel. This limitation means that a school is not required or encouraged to offer the AED training to a significant number of personnel on a school campus during the majority of the school day. S.B. 382 directs the State Board for Educator Certification to allow educators to receive continuing education credit for completing an instructional course on the use of an AED. As proposed, S.B. 382 amends current law relating to public school educator continuing education credit for instruction on the use of an automated external defibrillator. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the State Board for Educator Certification in SECTION 1 (Section 21.0541, Education Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter B, Chapter 21, Education Code, by adding Section 21.0541, as follows: Sec. 21.0541. CONTINUING EDUCATION CREDIT FOR INSTRUCTION RELATED TO USE OF AUTOMATED EXTERNAL DEFIBRILLATOR. Requires the State Board for Educator Certification to adopt rules allowing an educator to receive credit towards the educator's continuing education requirements for completion of an instructional course on the use of an automated external defibrillator that meets the guidelines for automated external defibrillator training approved under Section 779.002 (Training), Health and Safety Code. SECTION 2. Effective date: upon passage or September 1, 2015.
