A BILL TO BE ENTITLED
AN ACT
relating to the authority of a county or municipality to prohibit
hydraulic fracturing treatment.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 250, Local Government Code, is amended
by adding Section 250.007 to read as follows:
Sec. 250.007. RESTRICTION ON REGULATION OF HYDRAULIC
FRACTURING TREATMENT. A county or municipality may not prohibit
hydraulic fracturing treatment of oil or gas wells.
SECTION 2. This Act takes effect September 1, 2015.
