The bill would amend the Occupations Code and the Penal Code establishing how a professional sports team charitable foundation may conduct charitable raffles and providing a defense from prosecution in certain circumstances. The bill would take effect January 1, 2016 only if the related constitutional amendment is approved by voters. If the amendment is not approved, the bill would not take effect.The Office of Court Administration, Office of the Attorney General, Comptroller of Public Accounts, and Texas Lottery Commission indicated the costs associated with implementation of the bill could be absorbed with existing resources. Local Government Impact A Class C misdemeanor is punishable by a fine of not more than $500. Costs associated with enforcement and prosecution could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal impact. In addition to the fine, punishment can include up to 180 days of deferred disposition.
