A BILL TO BE ENTITLED
AN ACT
relating to the composition of the board of trustees of the
Employees Retirement System of Texas.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 815.003, Government Code, is amended by
amending Subsection (b) and adding Subsection (b-1) to read as
follows:
(b) Subject to Subsection (b-1), to [To] be eligible to
serve as an elected member of the board, a person must be:
(1) a member of the retirement system and must hold a
position that:
(A) [(1)] is included in the employee class of
membership; and
(B) [(2)] is not with an agency or department
with which another trustee holds a position; or
(2) a retiree.
(b-1) Only one elected member of the board may be a retiree.
SECTION 2. The changes in law made by this Act apply only to
an election of a member of the board of trustees of the Employees
Retirement System of Texas that occurs on or after the effective
date of this Act.
SECTION 3. This Act takes effect September 1, 2017.
