Pedestrian traffic on the roadside, as well as the frequent stops of vehicular traffic, can be very dangerous. There can also be health and safety concerns with roadside food vending trucks. Certain counties have the authority to prohibit roadside vending in the unincorporated portions of their county. H.B. 1107 allows Fort Bend County to be included in the list of counties that have the authority to prohibit roadside vending in the unincorporated portions of the county. H.B. 1107 amends current law relating to county regulation of roadside vendors and solicitors. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 285.001(a), Transportation Code, to authorize the commissioners court of a county with a population of more than 1.3 million and a county with a population of more than 550,000 that is adjacent to a county with a population of four million to, by order and to promote the public safety, regulate certain activities. SECTION 2. Effective date: upon passage or September 1, 2017.
