The bill would amend the Utilities Code to extend a restriction on the ability of municipalities to regulate electrical cooperatives.  Zoning or other land use regulations may not be used to exclude the cooperative from a municipality nor may they be directly in conflict with certifications granted under Chapter 37 of the Utilities Code.The Public Utility Commission anticipates the bill would have no significant fiscal impact and could be accomplished using existing resources.The bill would take effect September 1, 2017 Local Government Impact According to the Public Utility Commission, the bill may have a local impact, but the agency cannot estimate any impacts to municipalities at this time.According to the Texas Municipal League, the bill is anticipated to have no significant fiscal impact on municipalities.
