LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION April 1, 2017 TO: Honorable Drew Darby, Chair, House Committee on Energy Resources FROM: Ursula Parks, Director, Legislative Budget Board IN RE:HB1481 by Lozano (Relating to the abolition of the fee established by the commissioner of the General Land Office for processing applications for terminal facility discharge prevention and response certificates.), As Introduced No significant fiscal implication to the State is anticipated. The bill would amend the Natural Resources Code to remove the requirement that the General Land Office (GLO) assess a fee to obtain a discharge prevention and response certificate for oil handling facilities. There are 575-600 oil handling facilities in Texas and they are certified for five-year periods, for which GLO assesses a $25 fee. Based on the average certification fee revenue for fiscal years 2012 to 2016, GLO projects this bill will result in a revenue loss of $3,260 per fiscal year. Based on the analysis of GLO and the Comptroller of Public accounts, the revenue loss resulting from the certification fee not being collected would not result in a significant fiscal impact. Local Government Impact No significant fiscal implication to units of local government is anticipated.
