                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION            May 2, 2017      TO: Honorable Joe Moody, Chair, House Committee on Criminal Jurisprudence      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB1997 by Minjarez (relating to authorizing a fee for certain pretrial diversion programs.), Committee Report 1st House, Substituted    No significant fiscal implication to the State is anticipated.  This bill would amend the Code of Criminal Procedure to allow county pretrial services offices to impose a new supervision fee of up to $60 per month from defendants participating in a pretrial diversion intervention.  Requires these funds to be deposited in a special fund of the county treasury for the pretrial service office serving the county.  Restricts use of this fund to the county diversion program.According to the Comptroller of Public Accounts, the bill would have no state revenue implications because supervision fees are retained at the local level. According to the Office of Court Administration, no significant fiscal impact to the state court system is anticipated.According to the Department of Criminal Justice, no significant fiscal impact is anticipated.  The bill would take effect September 1, 2017. Local Government Impact According to the Texas Association of Counties, the fiscal impact of the bill cannot be determined.
