The bill would amend the Business and Commerce Code relating to surcharges imposed for the use of a credit card; providing a civil penalty. The bill would create liability for certain persons for a civil penalty of up to $500. The bill would eliminate provisions relating to the exclusive jurisdiction of the commissioner. The bill could increase the number and amount of civil penalties collected; however the number and amount cannot be determined. The Office of the Attorney General, Office of Court Administration, and Consumer Credit Commission anticipate any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.
