                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION            March 30, 2017      TO: Honorable Phil King, Chair, House Committee on Homeland Security & Public Safety      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB245 by Johnson, Eric (Relating to certain reporting requirements for law enforcement agencies; providing a civil penalty.), Committee Report 1st House, Substituted    No significant fiscal implication to the State is anticipated.  The bill would amend the Code of Criminal Procedure to require the Attorney General to conduct an investigation relating to a law enforcement agency's failure to comply with reporting requirements for certain injuries or deaths caused by peace officers. The bill would add a civil penalty if failure to comply continues after notification.According to the Office of the Attorney General, any additional work resulting from the passage of this bill could be absorbed within current agency resources.The bill would take effect September 1, 2017.  Local Government Impact The bill would have an impact on local governments by imposing a civil penalty if it is determined that a law enforcement agency failed to comply with reporting requirements.
