A BILL TO BE ENTITLED
AN ACT
relating to the authority of a city attorney to seek an injunction
to abate a common nuisance under the Alcoholic Beverage Code.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 101.70(b), Alcoholic Beverage Code, is
amended to read as follows:
(b) The county or district attorney in the county where the
nuisance exists, the city attorney in the city where the nuisance
exists, or the attorney general may sue in the name of the state for
an injunction to abate and temporarily and permanently enjoin it.
Except as otherwise provided in this section, the proceeding is
conducted as other similar proceedings.
SECTION 2. This Act takes effect September 1, 2017.
