                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION            April 22, 2017      TO: Honorable René Oliveira, Chair, House Committee on Business & Industry      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB2727 by Lucio III (Relating to access to a residence or former residence to retrieve personal property, including access based on danger of family violence.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Property Code by allowing an applicant for a writ to enter a residence or former residence to retrieve personal property including electronic records containing financial or legal information with a peace officer due to a clear and present danger of family violence to the applicant or the applicant's dependent. The bill authorizes a justice of the peace if they find a clear and present danger of family violence to the applicant to issue a temporary ex parte writ authorizing entry and property retrieval lasting no longer than five days.   Local Government Impact According to the Justice of the Peace and Constables Association (JPCA) and Texas Municipal League (TML) no significant fiscal impact to local units of government are expected from provisions of the bill.
