                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION            April 29, 2017      TO: Honorable Dan Huberty, Chair, House Committee on Public Education      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB2872 by Burns (Relating to the authority to issue an arrest warrant or citation for certain Class C misdemeanors committed by certain children on school property.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Education Code related to arrests for certain Class C misdemeanors. The bill would: allow a warrant to be issued for the arrest of a person for certain offenses committed while the person was in a disciplinary alternative education program; allow peace officers and school resource officers to issue citations to certain students; and specify the circumstances under which a school may file a complaint against a child with a criminal court. The bill would take effect September 1, 2017. This analysis assumes the provisions of the bill addressing sanctions for criminal offenses would not result in a significant impact on state correctional agencies.
