A BILL TO BE ENTITLED
AN ACT
relating to standards used by the Public Utility Commission of
Texas to evaluate proposed routes of a transmission project.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 37.056, Utilities Code, is amended by
adding Subsection (e) to read as follows:
(e) In considering an application for a certificate for a
transmission project for which alternative routes have been
proposed, the commission shall include in the evaluation of each
route the cost to the applicant of acquiring access to land,
rights-of-way, easements, or other property.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2017.
