Morrison, Chair, House Committee on Transportation      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB3061 by Guillen (Relating to operating a motor vehicle while a person is occupying the trunk of the motor vehicle; creating a criminal offense.), Committee Report 1st House, Substituted    No fiscal implication to the State is anticipated.  The bill would amend the Transportation code prohibiting operating a vehicle while a person is occupying the trunk. The bill would create a Class B misdemeanor for violating the provisions of the bill.The bill would take effect September 1, 2017. Local Government Impact A Class B misdemeanor is punishable by a fine of not more than $2,000, confinement in jail for a term not to exceed 180 days, or both. Costs associated with  enforcement, prosecution and confinement could likely be absorbed within existing resources.
