(Relating to the designation of a common area for on-premise consumption by a holder of certain alcoholic beverage permits and licenses.), Committee Report 1st House, Substituted No significant fiscal implication to the State is anticipated. The bill would amend the Alcoholic Beverage Code to authorize certain permit or license holders to designate a common area where an alcoholic beverage may be transferred from certain permitted or licensed premises. The bill provides certain locations where a designated common area can be located.The bill would subject alcoholic beverages transferred to the designated common area to an excise tax and would require the filing of monthly excise tax reports with the Texas Alcoholic Beverage Commission. The Comptroller of Public Accounts reports that the provisions of the bill would have no significant effect on revenue collections.The bill would also authorize the suspension or cancellation of a permit or a license if an act that is grounds for suspension or cancellation occurs at an authorized common tasting area.The Comptroller of Public Accounts and the Texas Alcoholic Beverage Commission report that the costs to implement the provisions of the bill could be absorbed within existing resources.The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house. Otherwise, the bill would take effect September 1, 2017. Local Government Impact No significant fiscal implication to units of local government is anticipated.
