                    BILL ANALYSIS             H.B. 3090     By: Cyrier     Environmental Regulation     Committee Report (Unamended)             BACKGROUND AND PURPOSE    Interested parties express concern over the inadequate and untimely enforcement of laws and rules relating to the outdoor burning of waste and combustible material. H.B. 3090 seeks to address this concern by providing for enforcement of such laws and rules by a peace officer.       CRIMINAL JUSTICE IMPACT   It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.       RULEMAKING AUTHORITY    It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.       ANALYSIS    H.B. 3090 amends the Health and Safety Code to authorize Texas Clean Air Act provisions relating to outdoor burning of waste and combustible material and rules adopted under such provisions by the Texas Commission on Environmental Quality to be enforced by a peace officer.       EFFECTIVE DATE    September 1, 2017.
