This bill would amend the Labor Code relating to the consideration by certain employers of the consumer credit reports of certain employees and applicants for employment; providing administrative penalties. The Texas Workforce Commission (TWC) estimates that implementing the provisions of the bill would result in additional complaints and increased workload. Based on the LBB's analysis of TWC, this analysis assumes the duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. Additionally, any costs to the state could be offset by penalty revenue. Based on information provided by the Comptroller of Public Accounts, the amount and timing of the penalty revenue is currently unknown; therefore, the fiscal impact cannot be determined.
