85R11118 MCK-F By: Dale H.B. No. 3315 A BILL TO BE ENTITLED AN ACT relating to the authorized locations for certain tastings and evaluations of home-produced alcoholic beverages. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 12, Alcoholic Beverage Code, is amended by adding Section 12.08 to read as follows: Sec. 12.08. TASTING COMPETITION. (a) The holder of a brewer's permit described by Section 12.052 may hold a tasting competition on the brewer's premises that includes the consumption but not the sale of malt liquor produced by a person who is authorized under Section 109.21(a) to produce the malt liquor. (b) The holder of a brewer's permit who holds a tasting competition under Subsection (a) must file a surety bond in the amount of $500. SECTION 2. Subchapter A, Chapter 27, Alcoholic Beverage Code, is amended by adding Section 27.012 to read as follows: Sec. 27.012. TASTING COMPETITION. (a) The holder of a temporary wine and beer retailer's permit may hold a tasting competition on the premises for which the permit is issued that includes the consumption but not the sale of beer or malt liquor and produced by a person who is authorized under Section 109.21(a) to produce the beer or malt liquor. (b) The holder of a temporary wine and beer retailer's permit who holds a tasting competition under Subsection (a) must file a surety bond in the amount of $500. SECTION 3. Subchapter B, Chapter 27, Alcoholic Beverage Code, is amended by adding Section 27.111 to read as follows: Sec. 27.111. TASTING COMPETITION. (a) The holder of a special three-day wine and beer permit may hold a tasting competition on the premises for which the permit is issued that includes the consumption but not the sale of beer or malt liquor produced by a person who is authorized under Section 109.21(a) to produce the beer or malt liquor. (b) The holder of a special three-day wine and beer permit who holds a tasting competition under Subsection (a) must file a surety bond in the amount of $500. SECTION 4. Chapter 62, Alcoholic Beverage Code, is amended by adding Section 62.15 to read as follows: Sec. 62.15. TASTING COMPETITION. (a) The holder of a manufacturer's license described by Section 62.122 may hold a tasting competition on the manufacturer's premises that includes the consumption but not the sale of beer produced by a person who is authorized under Section 109.21(a) to produce the beer. (b) The holder of a manufacturer's license who holds a tasting competition under Subsection (a) must file a surety bond in the amount of $500. SECTION 5. Chapter 74, Alcoholic Beverage Code, is amended by adding Section 74.12 to read as follows: Sec. 74.12. TASTING COMPETITION. (a) The holder of a brewpub license may hold a tasting competition on the brewpub's premises that includes the consumption but not the sale of beer or malt liquor produced by a person who is authorized under Section 109.21(a) to produce the beer or malt liquor. (b) The holder of a brewpub license who holds a tasting competition under Subsection (a) must file a surety bond in the amount of $500. SECTION 6. Section 109.22(b), Alcoholic Beverage Code, is amended to read as follows: (b) For the purpose of participating in an organized tasting, evaluation, competition, or literary review, a person to whom this section applies may deliver wine, ale, malt liquor, or beer produced and manufactured by the person to locations that are not permitted or licensed under this code or, as provided by Section 12.08, 27.012, 27.111, 62.15, or 74.12, to a permitted or licensed premises, for the purpose of submitting those products to an evaluation at an organized tasting competition that is closed to the general public or by a reviewer whose reviews are published if[: [(1)] no charge of any kind is made for the wine, ale, malt liquor, or beer, for its delivery, or for attendance at the event[; and [(2) the commission consents in writing to the delivery]. SECTION 7. This Act takes effect September 1, 2017.
