A BILL TO BE ENTITLED
AN ACT
relating to the conduct of a live sound study after the completion
of certain transportation projects.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter H, Chapter 201, Transportation Code,
is amended by adding Section 201.6105 to read as follows:
Sec. 201.6105. LIVE SOUND STUDY. Not later than one year
after the department completes a transportation project that
includes a sound barrier, the department shall conduct a live sound
study to assess the implementation and effectiveness of the sound
barrier. If the results of the study show that sound mitigation
does not meet projected and modeled forecasts, the department shall
modify the existing sound barrier or construct a new sound barrier
to meet the forecasts.
SECTION 2. Chapter 372, Transportation Code, is amended by
adding Subchapter D to read as follows:
SUBCHAPTER D. TOLL PROJECT CONSTRUCTION
Sec. 372.151. LIVE SOUND STUDY. Not later than one year
after a toll project entity completes a toll project that includes a
sound barrier, the toll project entity shall conduct a live sound
study to assess the implementation and effectiveness of the sound
barrier. If the results of the study show that sound mitigation
does not meet projected and modeled forecasts, the toll project
entity shall modify the existing sound barrier or construct a new
sound barrier to meet the forecasts.
SECTION 3. This Act takes effect September 1, 2017.
