                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION            April 24, 2017      TO: Honorable Dan Huberty, Chair, House Committee on Public Education      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB356 by Huberty (Relating to the carrying of concealed or holstered handguns by certain handgun license holders attending a meeting of the board of trustees of a school district or the governing body of an open-enrollment charter school.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Penal Code to create a defense to the prosecution for possession of a firearm on the premises of any primary or secondary school and in the room where an open meeting of a governmental body is being held and notice has been given. The exception would apply to the concealed possession of a handgun at a school board meeting if the individual carrying the handgun is properly licensed and is attending the meeting in an official capacity as a superintendent, member of the board, or in a similar governing role. Based on the analysis of the Office of Court Administration, the Department of Public Safety, and the Texas Education Agency, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
