A BILL TO BE ENTITLED
AN ACT
relating to the applicability of Texas Commission on Environmental
Quality rules relating to recycling facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 361.119, Health and Safety Code, is
amended by adding Subsection (g) to read as follows:
(g) Rules adopted under Subsection (f) must require
financial assurance in an amount not less than $25,000 and must
apply to recycling facilities regardless of whether the facility
receives financial compensation for the acceptance of recyclable
material.
SECTION 2. This Act takes effect September 1, 2017.
