85R14488 SLB-D By: Faircloth H.B. No. 4088 A BILL TO BE ENTITLED AN ACT relating to the sunset review of navigation districts. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 325, Government Code, is amended by adding Section 325.026 to read as follows: Sec. 325.026. NAVIGATION DISTRICTS SUBJECT TO REVIEW. (a) A navigation district listed in Subsection (b) is subject to a limited review under this chapter as if it were a state agency. (b) This section applies to the: (1) Aransas County Navigation District; (2) Brownsville Navigation District; (3) Calhoun Port Authority; (4) Cedar Bayou Navigation District; (5) Chambers-Liberty Counties Navigation District; (6) Cypress Valley Navigation District; (7) Galveston County Navigation District No. 1; (8) Jackson County Navigation District; (9) Jefferson County Navigation District; (10) Matagorda County Navigation District No. 1; (11) Orange County Navigation and Port District; (12) Port Freeport; (13) Port Isabel San Benito Navigation District; (14) Port of Bay City Authority; (15) Port of Beaumont Navigation District; (16) Port of Corpus Christi Authority; (17) Port of Harlingen Authority; (18) Port of Houston Authority of Harris County; (19) Port of Port Arthur Navigation District; (20) Refugio County Navigation District; (21) Sabine Neches Navigation District of Jefferson County, Texas; (22) Sabine Pass Port Authority; (23) San Patricio County Navigation District No. 1; (24) Victoria County Navigation District; (25) West Side Calhoun County Navigation District; and (26) Willacy County Navigation District. (c) The limited review under this chapter must assess each navigation district's: (1) governance; (2) management; (3) operating structure; and (4) compliance with legislative requirements and the Texas Constitution. (d) A navigation district shall pay the cost incurred by the commission in performing the review. The commission shall determine the cost, and the district shall pay the amount promptly on receipt of a statement from the commission detailing the cost. (e) The commission shall establish a schedule for reviewing navigation districts under this section so that the first review of each district is completed not later than January 1, 2023. (f) Each district shall be reviewed every 12th year after the first review. (g) A navigation district is abolished on September 1 of the year in which the district's review is put before the legislature unless the district is continued by an act of the legislature. (h) Together with the commission's report on each navigation district reviewed under this section, the commission shall include recommendations regarding issues raised by the abolishment of the district if the district is not continued by an act of the legislature, including recommendations for legislation concerning wrapping up the business of the district. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2017.
