A BILL TO BE ENTITLED
AN ACT
relating to a daily storage fee charged by a vehicle storage
facility.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 2303.155(d), Occupations Code, is
amended to read as follows:
(d) For purposes of imposing a daily storage fee, a day is
considered to begin 24 hours from the time that the vehicle is towed
to a vehicle storage facility [at midnight and to end at the next
following midnight] until the same time the next following day. A
daily storage fee may [be charged regardless of whether the vehicle
is stored for 24 hours of the day, except that a daily storage fee
may not be charged for more than one day] if the vehicle remains at
the facility for less than 24 [12] hours.
SECTION 2. Section 2303.155(d), Occupations Code, as
amended by this Act, applies only to a vehicle that is towed to a
vehicle storage facility on or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2017.
