 A BILL TO BE ENTITLED
 AN ACT
 relating to applications for certain alcoholic beverage permits and
 licenses.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 11.46, Alcoholic Beverage Code, is
 amended by adding Subsection (e) to read as follows:
 (e)  The commission or administrator shall refuse to issue an
 original permit authorizing the retail sale of alcoholic beverages
 to an applicant who has been refused the same type of permit for the
 same premises three or more times.
 SECTION 2.  Section 61.42, Alcoholic Beverage Code, is
 amended by adding Subsection (e) to read as follows:
 (e)  The county judge, commission, or administrator shall
 refuse to approve or issue an original license authorizing the
 retail sale of alcoholic beverages to an applicant who has been
 refused the same type of license for the same premises three or more
 times.
 SECTION 3.  The changes in law made by this Act apply only
 with respect to an original alcoholic beverage permit or license
 application made on or after the effective date of this Act.
 SECTION 4.  This Act takes effect September 1, 2017.
