A BILL TO BE ENTITLED
AN ACT
relating to the applicability of competitive bidding requirements
to leases of radio towers and the land under radio towers procured
by the Parks and Wildlife Department.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter L, Chapter 11, Parks and Wildlife
Code, is amended by adding Section 11.302 to read as follows:
Sec. 11.302. LEASES FOR RADIO TOWERS AND RELATED LAND. The
competitive bidding requirements of Subtitle D, Title 10,
Government Code, do not apply to a procurement by the department of
a lease for:
(1) a radio tower; or
(2) land underlying a radio tower.
SECTION 2. Section 11.302, Parks and Wildlife Code, as
added by this Act, applies to a lease procured by the Parks and
Wildlife Department on or after the effective date of this Act. A
lease procured by the department before the effective date of this
Act is governed by the law in effect at the time the lease was
procured, and the former law is continued in effect for that
purpose.
SECTION 3. This Act takes effect September 1, 2017.
